These are the legal terms and conditions under which We supply the products (“Products”) listed on our website www.bombinitribe.com (“our site”) to you. Please read these terms and conditions carefully before ordering any Products from our site. Using our site indicates that you accept these terms and conditions. Together with our Privacy Notice and Terms of Use, regardless of whether you choose to register with us. If you do not accept these terms and conditions, our Privacy Notice or our Terms of Use, do not use our website.

Terms and Conditions

Bombini Tribe operates this website. Throughout the site, the terms “we”, “us” and “our” refer to Bombini Tribe. Bombini Tribe offers this website, including all Information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site or purchasing something from us, you engage in our “Service”. You agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein or available by hyperlink. These Terms of Service apply to all site users, including without limitation users who are browsers, vendors, customers, merchants, or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1, REFUND POLICY

If you are not completely satisfied with your purchase and you would require a refund you have 14 days from the day you receive your order to return any items to us.

All items MUST be returned in their original packaging with swing tags still attached and in an unused, saleable condition; otherwise, your return will NOT be accepted and will be sent back to you.

Please read the “IMPROPER RETURNS” section below for more details.

IMPROPER RETURNS

Where you return a product in contravention of this policy (and where you do not have any other legal right to return the Product):

  • Please note that we CANNOT accept returns or exchanges on underwear or swimwear due to hygiene reasons.
  • Please note ANY items returned covered in animal or human hair may NOT be swapped or refunded.
  • Please note we cannot accept any returned items that have been washed.
  • Returned items must be in re-sellable condition; that is the same condition that you received the item in.

Returns are processed within 5 working days of us receiving the goods back. It may take longer to process your return on Bank Holidays or at Christmas.

2, Shipping

To return your Product, you should mail your Product to: Bombini Tribe.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, your refund will be processed, and a credit will automatically be applied to your credit card or original payment method within 7 working days.

Please allow between 1-5 days for your order to arrive. If more than 14 days have passed, please email us at info@bombinitribe.com to review the status of your order.

3, Cancelling Your Order

Order cancellation, you can cancel your order and anytime up until your item/s have been dispatched and receive a fund refund. Once items have been dispatched, you must return the item/s under our REFUND POLICY. Please email: info@bombinitribe.com with you full order reference and you will receive confirmation via email to request an order cancellation.

Under Consumer Regulations, you have the right to cancel your order as long as you do so no later than 14 days after the day on which you receive the goods or Service. Please be aware that your right to cancel does not apply to certain goods that we sell. For example, items made or customised to your order, (such as personalised goods), jewellery items.

You must inform us of your wish to cancel in writing either by letter, email within a period of 14 days, beginning on the day after the day you receive your goods. It would be best if you took reasonable care of the goods and not use them. You should return goods to us in their original packaging, wherever possible, within 14 days of informing us of your wish to cancel. 

We cannot accept substitute or alternative items by way of returns, nor can we send them back to you, so please look closely at the items you return to us. Return or attempt to return substitute or alternative items. You will still be responsible for paying for the original item purchased. We reserve the right to charge an investigation fee of no less than £35 to cover the cost of our investigating the position. 

We can offset this amount due to other sums that may be due to you for refunds. Accepting returned goods or crediting an account does not constitute a waiver of our right to charge an investigation fee. Please contact your Citizens Advice Bureau or a Solicitor for full details of your rights under the Consumer Protection Regulations.

4, ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

5, GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve. (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the products and Service, use the Service, or access the Service or any contact on the website through which the Service is provided without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

6, HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

  1. Once you have placed your order, you should receive an e-mail from us acknowledging that We have received your order (but please contact us if you do not receive this e-mail). Please note this does not mean that your order has been accepted. All orders are subject to availability and acceptance by us (which We may refuse for any reason).
  2. After you submit your order, we immediately contact your bank or card issuer for authorisation to take payment from your account. We will not process your order until payment gets received in full. If we accept your order. We will confirm this to you by sending you a further e-mail confirming the Product is being processed ready for dispatch at which point the Contract between us (“Contract”) will be formed.
  3. As soon as you place your order, we start to process your order which means you will not be able to change it before delivery, but you may be able to return your Products under clause 8 of these terms and conditions or under our Returns Policy.
  4. From time to time We may make minor changes to a Product to reflect changes in relevant laws and regulatory requirements.
  5. These terms and conditions, and any Contract between us, are only in the English language. Please note that We may not necessarily keep a copy of your Contract. You should keep a copy of these terms and conditions and your order for future reference.

7, PRICE AND PAYMENT

  1. The price payable for the Products shall be as shown on our site in pounds sterling (GBP). However, please see clauses 7.5 and 7.6 for what happens if We discover an error in the price of any Product you order. Prices advertised on our site include UK VAT at the relevant rate chargeable for the time being. But exclude delivery charges which are payable in addition and shown separately during the checkout process.
  2. We can change the prices on our site without notice, but changes will not affect orders that we have already accepted. However, if the rate of VAT changes after the date of your order, We will adjust the rate of VAT you pay unless you have already paid for the Products in full before the change in VAT takes effect.
  3. We accept payment by debit card, credit card, Apple Pay (iOS only), PayPal, Clearpay, Klarna, Laybuy and Zippay(not available on App). We accept the following cards: Visa, VISA Electron, Mastercard, Maestro, American Express.
  4. You must pay for the Products (including all applicable delivery charges), and We will charge the card you have chosen to use to pay for your order once you reach the final billing page and submit your order. We immediately contact your bank or card issuer for authorisation to take payment from your account. If you are using Stripe, PayPal or Clear pay, such payment will be subject to additional terms between you and the card vendor.

8, FAULTY PRODUCTS

  1. If you are a consumer, We are under a legal duty to supply Products that conform with the Contract. Nothing in these terms and conditions will affect your legal rights in relation to faulty or defective products.
  2. If you consider that any Product We have supplied is faulty or misdescribed, please notify us using the contact details set out in clause 8.2.
  3. If you discover that your product is faulty after 14 days we reserve the right to request evidence. Such as images of the defect, before issuing any refund of the price paid and/or any associated delivery costs.

 

9, OUR RIGHTS TO CANCEL THE CONTRACT

  1. We may end the Contract at any time by writing to you if:
    1. you do not make any payment to us when it is due;
    2. you do not, within a reasonable time of us asking for it, provide us with Information that is necessary for us to deliver the Products; or
    3. You do not, within a reasonable time, allow us to deliver the Products to you.
  2. We may also end the Contract in the circumstances set out in clause 9.1.
  3. If We end the Contract in any of the situations set out in our T&C’s, We will refund any money you have paid in advance for the Products. We have not provided, but We may deduct or charge you reasonable compensation for the costs. We will incur due to your breaking the Contract.

10, OUR LIABILITY

  1. Suppose We fail to comply with these terms and conditions. In that case, We are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failing to use reasonable care and skill. Still, We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, you and we knew it might happen.
  2. We only supply the Products for domestic and private use. Use the Products for any commercial, business or resale purpose. We will have no liability to you for any loss of profit, loss of business, loss of anticipated savings, business interruption or loss of business opportunity.
  3. We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation. Or any matter for which We may not exclude or limit our liability under any applicable law.

11, EVENTS OUTSIDE OUR CONTROL

  1. We will not be liable or responsible for any failure to perform or delay any of our obligations under a Contract caused by an Event Outside Our Control. An Event Outside Our Control means any act, event, omission or accident beyond our reasonable control.
  2. Suppose an Event Outside Our Control takes place that affects the performance of our obligations under a Contract. In that case, We will contact you as soon as reasonably possible to notify you, and our obligations under the Contract will get suspended. 
  3. The time for performance of our obligations will be extended for the duration of the Event Outside Our Control. The Event Outside Our Control affects our delivery of Products to you. We will arrange a new delivery date with you after the Event Outside Our Control is over.
  4. You may cancel a Contract affected by an Event Outside Our Control if there is a risk of substantial delay. To cancel a Contract please contact us using the details set out in clause above.

INTELLECTUAL PROPERTY RIGHTS

  1. We or our licensors shall own all and any Intellectual Property Rights in the Products. All such rights are reserved.
